New Zealand Olympic Travel Package Terms and Condition


PLEASE READ THESE CONDITIONS CAREFULLY.

BY MAKING A BOOKING WITH US YOU CONFIRM YOUR ACCEPTANCE OF THESE CONDITIONS

  1. OUR SERVICES AND OBLIGATIONS

    1. The New Zealand Olympic Committee and House of Travel Christchurch City Limited together trading as New Zealand Olympic Travel (“we”, “NZOT” or “us”) have been appointed an Authorised Ticket Reseller for the Tokyo Organising Committee of the Olympic and Paralympic Games (“Tokyo 2020”). We supply travel agency services consisting of arranging, booking and co- ordinating travel facilities and services to the Tokyo 2020 Olympic Games (“Travel Packages”). The actual services and products are provided, supplied or performed by Principal(s) of travel, entertainment, and accommodation facilities or services (“Principal(s)”).

    2. We undertake to perform our travel agency services described in Clause 1.1 above (“the Services”) with reasonable care and skill.

    3. Neither NZOT, the New Zealand Olympic Committee or House of Travel Christchurch City Limited shall be liable for any failure to perform any obligation under the terms and conditions of this Agreement to the extent that the failure is caused by Force Majeure or by the acts of third parties.

    4. For the purposes of this clause ‘Force Majeure’ means any cause beyond NZOT's control which results in or causes failure to perform any of its obligations or makes performance of any or all of its obligations materially more difficult or expensive including, without limitation: acts of God, fire, explosion, weather, earthquake or environmental events, war, insurrection, riot, civil disturbances, industrial action, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, public health emergency, acts or regulations of national, state, or local governments, and a fault or failure of plant, machinery, payment systems, computer or communications equipment or software (that could not have been prevented by Best Industry Practice).

    5. We will endeavour to provide the most suitable travel arrangements to meet the particular requirements you make known to us. However, travel is an individual experience, and your preferences and opinions may vary from our own. For this reason, we cannot take responsibility for your individual satisfaction.

  2. TRAVEL PACKAGES

      1. Public Travel Packages are sold on a first-in, first-served basis and a deposit needs to be paid to confirm the package within 3 working days of purchase.

      2. Full names of all travellers as per passport will be required at the time of Travel Package confirmation. We will require copies of passports of all travellers.

      3. You are required to advise us if any of the details you provide change from the information provided at the outset.

      4. It is imperative that when advising us of the names of those travelling that the spelling provided exactly matches the spelling in the traveller’s passport or the traveller may be denied boarding on an aircraft or entry into a country.

      5. All documentation, excluding Tokyo 2020 event tickets, will be sent to you no less than 30 days prior to the date of travel.

      6. All Travel Packages are non-transferrable, except if requested in writing to NZOT and at the sole discretion of NZOT.

      7. Any amendments to the Travel Package following confirmation will incur an amendment fee, as well as any fees passed on to NZOT by our Principals both of which must be paid by you.

  3. SUPPLY OF TRAVEL, ENTERTAINMENT AND ACCOMMODATION, SERVICES AND FACILITIES BY PRINCIPAL(S)

      1. When we make bookings with Principal(s), we are acting as a booking agent for such Principal and make no representation or give no warranty regarding the quality of their services.

      2. All travel, entertainment, and accommodation facilities or services are supplied directly to you by the Principal(s). We have no control over the Principal(s) themselves, or the manner in which they provide their services and products. Accordingly we will not be liable for any loss or damage of any kind which may arise from your use or consumption of, or inability to use or consume facilities, products, or services provided by a Principal.

      3. The provision by Principal(s) of their facilities or services is subject to the further terms and conditions of each Principal.

      4. Where for any reason, a Principal is unable to provide particular facilities or services, then that Principal may be entitled, subject to its terms and conditions, to substitute those services or facilities with comparable or equivalent facilities or services without incurring any liability to you. We will endeavour to provide such terms and conditions if required by you.

      5. All facilities or services described by us are subject to availability from the Principal.

      6. We will not be liable or responsible for any loss or damage relating to your baggage, personal possessions, health or welfare, or delays or travel disruptions unless these arise directly from our provision of the Services.

      7. You agree to indemnify us for any loss or damage we suffer due to any damage or injury caused by your actions.

  4. ACCOMMODATION

    1. Accommodation will be provided at pre-determined hotels.

    2. Guests may need to change rooms during their stay if multiple Travel Packages are purchased.

    3. Guests may need to change rooms when purchasing additional nights to extend their Travel Package duration.

    4. We may not be able to arrange early check-in or late check-out. If it is able to be arranged, this will be at an additional cost, to be paid by the guest.

    5. Hotel incidentals are the responsibility of the Travel Package purchaser and a credit card or cash security may be required by the Hotel at the time of check-in for the duration of the guest stay.

    6. Accommodation cost is based on two people sharing unless otherwise indicated. Bedding configurations are not confirmed. Rooms in Japan are mainly twin beds (two beds per room) rather than double (one bed per room), therefore we are unable to guarantee double beds.

    7. All accommodation allocations are final.

  5. ACCESSIBILITY

    5.1 It is your responsibility to notify us of any needs for wheelchair accessible rooms and/or wheelchair or other accessibility requirements for Tokyo 2020 tickets. Wheelchair accessible rooms and accessible Tokyo 2020 tickets are subject to availability and cannot be guaranteed. NZOT cannot provide individual assistance for walking, dining, getting on/off vehicles, or other needs. It is your responsibility to make relevant arrangements.

  6. TICKETS

      1. NZOT can only accept requests for Travel Packages including Tokyo 2020 tickets from New Zealand residents. Proof of New Zealand residency may be requested at any stage through the Package selling process and will be required by all ticket holders over the age of 18 at the time of ticket collection.

      2. Tokyo 2020 Tickets are sold subject to the NZOT Ticket Terms and Conditions and the Tokyo 2020 Terms and Conditions of Ticket Purchase and Use which must be accepted by all ticket holders at the time of purchase.

  7. PRICES

      1. All prices are on a per person basis

      2. All Tokyo 2020 Tickets are sold at the approved sell price, listed on www.nzolympictravel.co.nz

      3. All prices unless otherwise specified are expressed in New Zealand Dollars.

      4. Prices may be subject to variation between the time of booking and the date of departure due to events beyond our control. We reserve the right to vary the price up to the time of your departure and accordingly Travel Package pricing is subject to final confirmation.

      5. Unless otherwise specified, the costs of domestic/international flights, tipping (where applicable), additional meals, any transportation that is not specified as included in the package, early arrival or late checkout charges, hotel extras, visas, insurance, in-country additional taxes, charges or levies, and items of a personal nature are not included.

  8. PAYMENTS

      1. Payment is required as follows:

        • A deposit of $2,000 per person for packages valued less than $10,000 total, and $3,000 per person for packages valued greater than $10,000 per person is required within 3 days of confirmation of your booking;

        • Full payment is due 10 September 2019

        • We accept payment by cheque, cash, direct credit, credit card, QCard or GEM Visa.

        • Payment by credit card, Q Card or GEM Visa does attract fees which are payable by the purchaser depending on the credit card type used.

        • If additional travel services are purchased beyond the package inclusions, different payment terms may apply.

  9. CANCELLATION

    9.1 All Travel Packages are non-refundable. We recommend travel insurance to be purchased at the time of booking to cover cancellation due to unforeseen circumstances.

  10. VISAS AND PASSPORTS

    10.1 You are responsible for ensuring you have valid passport and necessary visas or permits prior to the commencement of travel to Australia. All such documentation is your sole responsibility. While NZOT is able to assist with obtaining documentation we accept no responsibility or liability whatsoever for your failure to obtain the appropriate documentation and/or if you are refused entry at customs or immigration

  11. BUSINESS PURPOSE

    11.1 You agree that where our a Travel Package is acquired for business purposes, or where you hold yourself out as acquiring a Travel Package for business purposes, the Consumer Guarantees Act 1993 will not apply to any supply of services made under these conditions, and we will not be liable or responsible for any loss or damage of any kind to you, including an consequential loss or damage however it may be caused.

  12. NON-USE OF SERVICES OR FACILITIES

    12.1 If you decide not to use part or parts of the arranged services or facilities, you will not be entitled to a refund from us (provided we carried out our service with reasonable skill and care) and you may not be entitled to a refund from any Principal.

  13. SERVICE SATISFACTION

    13.1 If you encounter any situation where the service supplied to you does not meet your satisfaction, please take the matter up with the Principal immediately. Your contract for each service is with the Principal. If this is not possible, or if you are still dissatisfied, please contact us. We will endeavour to investigate on your behalf and to negotiate with the Principal to resolve the matter as soon as possible.

  14. LEGAL CLAIMS

    14.1 You agree that any claims or legal action in connection with the provision of the Services to you will be governed by the laws of New Zealand. Any claim or legal action against Principal(s) is likely to be subject to the terms of your contract with them, and may be governed by the laws of other countries.

  15. PRIVACY ACT WAIVER

    15.1 You consent to us providing the following Personal Information to suppliers to undertake the booking of your Travel Package: your names and address and passport number or other form of identity; your travel details and contact details.

I agree that by purchasing a Travel Package that myself and all other travellers included in my booking are to be bound by these Terms and Conditions and where I have also purchased tickets to Tokyo 2020 I agree I am bound by the NZOT Ticket Terms and Conditions and Tokyo 2020 Terms and Conditions of Ticket Purchase and Use, and that I have authority from all other travellers included in the booking to agree to all such terms on their behalf.
